Regulation for Behaviour Analysis & the impact to BACB credentials:
SEG Management Consultants Inc. completed a report for the Ministry of Children and Youth Services regarding certification/regulation for ABA practioners in Ontario. See Resources for the report.
The provincial government undertook a review of the need for regulation of Applied Behaviour Analysis (ABA). In its submission to this review, [CPO] indicated its willingness to consider undertaking this role should regulation of ABA be introduced.
The Health Professions Regulatory Advisory Council (HPRAC) Recommendations to the Minister Volume 1 & 2 were submitted to the Minister of Health and Long-Term Care. See Resources for the reports.
The College of Psychologists of Ontario reported: "The College is pleased to report that it has embarked on a process, with the Ministry of Children, Community and Social Services and the Ministry of Health to establish regulation of Applied Behavioural Analysis in Ontario."
CPO update: "The Ontario government introduced Bill 283, Advancing Oversight and Planning in Ontario’s Health System Act, 2021. Included in Schedule 4 of this Bill is the legislative authority for the College to regulate the profession of Applied Behaviour Analysis. The proposed legislation, if passed, will repeal the Psychology Act, 1991 and replace it with the Psychology and Applied Behaviour Analysis Act, 2021."
This was the first time professionals were able to review proposed title protection.
In preparation for proclamation of the Act, the College worked on developing regulations and policies required for the regulation of Behaviour Analysts.
The College launched a dedicated ABA Portal to post regular updates on the progress toward the Regulation of Applied Behaviour Analysis. Answers to the most frequently asked questions were also included on the website.
The College drafted Regulations related to the registration of Behaviour Analysts and these were shared for review and feedback up until December 2022.
"On December 16, 2022, the Council approved the amendments to the Registration Regulation (O. Reg. 74/15), General Regulation (O. Reg. 209/94) and Professional Misconduct Regulation (O. Reg. 801/93) for submission to the Ministry of Health. The formal submission package was submitted to the Ministry on January 18, 2023."
"The College of Psychologists of Ontario announced that on July 20, 2023, the Lieutenant Governor in Council approved the regulations, under the Psychology and Applied Behaviour Analysis Act, 2021 (the “Act”), for the profession of Applied Behaviour Analysis (ABA). The Act will be proclaimed effective July 1, 2024, when the College will change its name to the College of Psychologists and Behaviour Analysts of Ontario. After that date, only ABA practitioners who are registered with the College will be allowed to use the title “Behaviour Analyst” in Ontario."
The BACB® shared that "the final requirements authorized in the Psychology and Applied Behaviour Analysis Act in 2021 (Act) are not based on BACB® standards, certifications, or certification tiers."
"In addition, the Act includes highly restrictive title protections that will negatively impact BACB® certifications. These restrictions are rigorous and will directly impact the BACB®’s activities in Ontario. Beginning July 1, 2026, when Transitional Route 1 expires, Ontario residents will no longer be able to apply for BCBA® certification or take the examination." See Resources for the letter.
"The College Council approved the distribution of the By-laws for public consultation at their meeting on December 15, 2023." They were available for feedback until February 16, 2024. Despite low response rates (58 out of an estimated 5000 that reportedly received the link) and any feedback that was received, the By-laws were approved as is by council. The meeting was available on the CPO's YouTube channel, however has since been removed.
ONTABA informed its membership of the opportunity to provide feedback the week after the opportunity to provide feedback had closed.
Draft Standards of Practice were also posted for public consultation until March 8, 2024. Low feedback response rates were also noted and feedback received led to the Standards undergoing revision. The revised standards of practice were approved in the May 2024 meeting without further consultation.
On July 1, 2024 the Psychology and Applied Behaviour Analysis Act, 2021 was proclaimed.

"For over 20 years, ONTABA has advocated for the Ontario government to regulate the practice of behaviour analysis, and the Behavior Analyst Certification Board (BACB®) has been extremely helpful in this pursuit. For example, ONTABA heeded the advice of the BACB® to encourage the province of Ontario to use the BACB® credentials as the basis to qualify for regulation. To our knowledge, the Ontario government has supported this request and is in the process of regulating behavior analysts (with BACB® credentials) autonomously within the College of Psychologists of Ontario (CPO)."

"ONTABA is recommending regulation of three levels of Behaviour Analysts rather than one single level in order to uphold the goal of public protection. These levels are:
Doctoral Level - Doctoral Behaviour Analyst
Master’s Level - Behaviour Analyst
Bachelor’s Level - Assistant Behaviour Analyst
ONTABA recognizes the vital roles that doctoral level clinicians and bachelor’s level clinicians play, in addition to the master’s level clinicians, in the delivery of behaviour analytic services in Ontario across a wide-range of settings for diverse populations. Doctoral level clinicians are often involved in consultation and oversight of complex cases or those that pose significant risk. Bachelor’s level clinicians comprise a significant proportion of providers in the province, and including them in regulation is necessary for both public protection and capacity building."
"ONTABA is recommending that the criteria to qualify for entry to practice for each level of behavioural clinician be aligned with the education and experience criteria set by the BACB® along with ethics & jurisprudence standards relevant to Federal and Provincial legislation. Criteria should also include relevant competency requirements (e.g. exams, interviews or evaluations)."

We trust this message finds you well. We have an important follow up message in relation to the message that the Behavior Analyst Certification Board (BACB) sent earlier today regarding the necessary transition from the BACB certification to College regulation in Ontario. Please click here to read the message from the BACB.
As per the message from the BACB, effective July 1, 2024, upcoming changes to their certification process will include the following implications:
1) Active BCBAs/BCBA-Ds in Ontario will not be able to use their certification until they are registered with the College
2) All current BCaBA certificants in Ontario will have their certification placed on voluntary inactive status by the BACB
3) Ontario residents can no longer apply for BCaBA certification or take the examination
4) All current RBT certificants in Ontario will have their certification placed on voluntary inactive status by the BACB
5) Ontario residents can no longer apply for RBT certification or take the examination
Please note that the BACB has provided further details about upcoming changes effective July 1, 2024 and beyond. We encourage our members who are certified through the BACB to carefully read the entire message from the BACB sent earlier today because additional substantial changes will go into effect on July 1, 2026.

An update to the OAP Clinical Supervisor timelines: "The Ministry has extended the timeline for practitioners providing behavioural services in the Ontario Autism Program to meet all qualification requirements from April 1, 2024, to July 1, 2024. To reflect this extended timeline, the clinical supervisor attestation form has been updated and posted on the Ministry’s website.
ABA providers who are continuing to work towards the qualification requirements must continue to complete and sign this Clinical Supervisor Attestation Form."

"The CPO has identified May 17th, 2024 as the deadline to submit all your supporting documentation in order to ensure you receive your Certificate of Registration as a Behaviour Analyst Authorizing Autonomous Practice by July 1, 2024. In order to begin your registration process, please head over to the application portal.
You can also head over to the CPO website for a list of fees, timelines in the registration process, and a blueprint for the Jurisprudence and Ethics course. We are aware that the Jurisprudence and Ethics Course and Assessment in Applied Behaviour Analysis (JECAABA) has not yet been made available. As per the college email, when it is ready, those who have started their application process will receive a notification to complete the course."

"We have been informed that nearly 700 applications have been processed, with even more applications at various stages of being processed. We have also been informed by the College that an application form and application fee can be submitted before submitting the supporting documentation, although the application will only be processed once all information is received."
"The Jurisprudence and Ethics Course and Assessment in Applied Behaviour Analysis (JECAABA) course will be released in the coming weeks. Eligible candidates will be contacted directly by the College in order to confirm their access to the course. We have also been informed that the course does not have to be completed by May 17th in order for approval to occur by July 1st, however it needs to be completed before July 1st."

"The College has processed nearly 700 applications since preregistration opened on April 2nd, 2024, with many more that are in various stages of processing.
It is important that Route 1 applicants understand that the May 17th, 2024 deadline is for submitting a complete Route 1 application. For example, a complete application submitted by May 17th, 2024 will be processed by July 1st, 2024, which is within the standard 4-6 week processing time for straightforward applications. Applications submitted after May 17th, 2024 will still be processed, but the closer they are received to July 1st, 2024, the less likely it will be that the applicant will receive a certificate of registration on July 1st, 2024."
**Regulation Discussions Begin** There were early talks about creating a regulatory body to protect this vulnerable population, recognizing the need for oversight. At this time there were only about 10 behaviour analysts in Ontario, largely psychologists. The government wanted to expand this, so they promoted the Behavior Analyst Certification Board (BACB®) from the US to help grow the field.
**Building Capacity** The government funded training programs and paid for people to get their master’s degrees, encouraging them to become certified through the BACB®. This became the standard for government funded autism programs, ensuring high-quality, supervised care.
At the time of the SEG report the field had grown to include 181 BCBA®s & 15 BCBA-D®s (Jan 2013)
**Progress in Regulation** Regulatory committees started working quietly on the process. The president of PBEO was involved in these discussions.
The government provided Workforce Capacity grant funds to build capacity in the province. A portion of these funds went to increasing RBT® certified front line staff to build quality capacity for services in the province.
The effects of the announcements related to Ontario regulation and subsequent BACB® credentialing impacts were already being felt with the number of RBT® credentialed front line staff beginning to fall. The RBT® credential currently sets the standard for supervision of front line staff and requires continuing education for all implementers working with arguably the most vulnerable population in Ontario.
Currently in Ontario there are:
1549 BCBA®s & 37 BCBA-D®s (May 2024)
In a decade the field of behaviour analysis has grown significantly in Ontario (800% increase).
Immediate impact:
140 BCaBAs & 680 RBTs (887 as of September 2023) had their credential put on involuntary inactive as of July 1st.

It is interesting to note that the "BACB’s Mass Email Service may be used to notify BACB certificants of pending legislation, regulations, or procedures relating to government regulation of behavior analysts." and this was never utilized by CPO or ONTABA during the regulation process in Ontario.
